India's largest spring mattress manufacturer fights infringement suit against HYPNOS UK

PEPS, the largest spring mattress manufacturer in India is known for its aggressive strategy towards protecting its intellectual assets. One pertinent suit being fought by PEPS currently is the infringement suit against HYPNOS UK, a British bedding manufacturer of luxury products.
 
The British company tried to launch its brand, HYPNOS, in India in the year 2011, but could not do so in a full-fledged manner, owing to trade mark issues. PEPS was using the registered trade mark ‘HYPNOS’ for pillows since 2008, a brand name which is one of the most preferred in the Indian hospitality industry. PEPS has strongly objected to HYPNOS UK's entry into the Indian market by initiating an infringement suit in Bangalore against the British company. In response, the British Company filed a case for cancellation of the HYPNOS trade mark.
 
Owing to its aggressive advertising and promotion campaigns, PEPS is today a house hold name among the Indian consumers. Many of its brands from Spine Guard to HYPNOS are today widely recognized among the substantial majority of consumers. Peps Industries has also tied up with well-known mattress company Restonic Mattress Corporation of New York, and is its exclusive distributor in India.
 
HYPNOS UK, today is claiming that its mark is famous in India though it had not formally entered the Indian market. PEPS is contesting the British Company's claim arguing that the HYPNOS UK is not well known, and is not known to Indian consumers at all. The mark HYPNOS is continuous and consistent, and that it has acquired recognition among Indian consumers. Now, the HYPNOS case is pending before the Bangalore civil court and also before the Intellectual Property Appellate Board.  The Intellectual Property Appellate Board at Chennai faced with the task of determining whether PEPS' prior use of the trade mark in India supersedes the HYPNOS UK's claim of reputation.
 
When asked about the case, Mr. K. Madhavan, Managing Director of PEPS said, “At PEPS, we strongly believe in defending our legitimate legal rights and pursue the ends of justice, at all levels and forums. We have a trade mark registration for HYPNOS and are well within the scope of the law. We strongly believe that our judiciary will take the correct measures in protecting our rights and we wait for the law to take its own course.”
